What can be done on street encroachment:
1. A complaint may be filed on “DDA 311’ an app launched, which is started with the order of hon’ble SC for reporting un-authorised constructions/encroachment.(download, register, go to ‘STF enforcement drive’ and click photo and post.)
2. Make a call on toll free helpline number 1533 (NDMC area) and also on 1800110093 (For PWD area) for Najafgarh SDMC Zone( 28018818 for Dwarka area) and www.mcdonline.gov.in
3. To make a written complaint use of app ‘smartcity-311’ may be used for MCD complaints.
4. “encroachment” means unauthorised occupation of Gov-ernment land or public land by way ofputting temporary, semi-permanent or permanent structure for residential use or com-mercial use or
any other use;
5.Hon’ble SC held that public road can not be encroached;
6. Responsible officers must be held responsible;
7. Encroachment on public roads is a public wrong;
8. deprivation of livelihood rights given under Constitution must be taken away according to the procedure fair and rea-sonable;
9. Hon’ble SC strikes a balance between legal rights of a com-mon man and duties of Welfare state towards poor people hav-ing right to shelter and livlihood;
10. Varanda is also a public street;
11. An effective grievances redressal monitoring and follow up sys-tem should be put in place;
12. Action by SDMC should be taken under MCD Act against encroachers of public street u/s 461( for violation u/s 317,320,321,325,339). punishment upto 6 months and fine Rs. 5000 or both;
13. S-420 Tehbazari or Licences are issued by DC, SDMC.
14. As per DDA Act 1957, Hon’ble SC ordered to form STF in 2018 headed by VC, DDA consisting all concerned person to look after all public encroachments.
15. Town vending committee was formed which will decide Vending Zone shortly to accommodate squatters in a regulated manner;
16. Police need to take action u/s DP Act and IPC(268, 283/290 IPC) for causing public nuisance and obstructions on public street;
17. SDM of the area may issue conditional order u/s 133 Cr.P.C. for removal of nuisance;

Mr. Rajinder Singh, Retired ACP Delhi Police with 34 years of experience and an ace investigator.
